1. Introduction
Welcome to www.kidsdreamfactory.com (the "Site"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and products. By accessing or using our Site or services, you agree to be bound by these Terms, which form a legally binding agreement between you and KidsDreamFactory ("we," "us," "our"). If you do not agree to these Terms, you must not use our Site or services. Before renting our teepees, please make sure to thoroughly read and understand our Terms and Conditions. Due to high demand, we recommend that you book as early as possible and as soon as you have a date secured to avoid disappointment.
2. Services Provided
KidsDreamFactory offers a range of children’s party services, including but not limited to sleepover parties, teepee tent rentals, glamping tent rentals, picnic rentals, movie night rentals, and related event planning services (collectively, the “Services”). Specific details about our Services, including pricing, availability, and booking procedures, are provided on this Site and may be updated at any time without prior notice. Images shown on the Site are examples. Decorations, accessories, and individual items may vary depending on availability.
3. Booking and Payment
3.1 Booking Process To book our Services, you must complete the booking form on our Site, providing accurate and complete information. A booking is considered confirmed only once you have received a 50% deposit invoice from us and the deposit is paid. We reserve the right to refuse or cancel any booking at our sole discretion.
3.2 Deposit A 50% deposit is required to secure your booking. The remaining balance is due no later than 7 days before the event. The deposit is refundable only in accordance with the cancellation terms set out in Section 3.3 below.
3.3 Cancellation by Customer If the customer cancels the booking more than 4 weeks before the scheduled event date, the 50% deposit will be refunded in full. Cancellations made 4 weeks or less before the scheduled event date are non-refundable.
3.4 Cancellation by KidsDreamFactory If Kids Dream Factory must cancel a confirmed booking, all payments received from the customer, including the 50% deposit, will be refunded in full. Kids Dream Factory will notify the customer as soon as reasonably possible if a cancellation becomes necessary.
3.5 Rescheduling / Date Changes Customers may reschedule their event at no additional charge if the request is received at least 24 hours before the scheduled event start time. Any payments already made will be transferred to the rescheduled event date. All rescheduled dates are subject to availability and must be mutually agreed upon by the customer and Kids Dream Factory.
4. Delivery and Set-Up
4.1 Delivery and Collection Times Delivery and setup are generally completed by 3:00 PM on the scheduled event date. Collection is generally completed by 12:00 PM on the following day. Alternative delivery, setup, or collection times may be available upon request, subject to availability, and may incur an additional fee. Any additional fee will be confirmed before the booking is finalized.
4.2 Delivery Zone and Fees Kids Dream Factory provides delivery, setup, and pickup throughout our designated service areas in South Florida. Delivery fees may vary depending on distance, event location, and setup requirements. Any additional delivery fee will be confirmed with the customer before the booking is finalized. 4.3 Access / Setup Requirements The customer is responsible for ensuring that the designated setup area is clear and ready before Kids Dream Factory arrives. For insurance and safety reasons, KidsDreamFactory team members are not permitted to move furniture or other household items. If the setup area is not ready upon arrival, setup may be delayed or may need to be adjusted based on the available space.
4.4 Space Requirements / Setup Conditions The customer is responsible for providing sufficient space for the selected party setup. For our standard medium-size mattress setup, approximately 7 ft × 4 ft of clear floor space is required per mattress / tent. Other mattress sizes may be available upon request and may require different space dimensions. The setup area must be clean, dry, level, and free of obstacles or safety hazards. KidsDreamFactory reserves the right to adjust the layout or placement of equipment if the available space differs from the information provided at the time of booking or if the requested setup cannot be completed safely. Access to doors, emergency exits, and walkways must remain unobstructed.
5. Customer Responsibilities
5.1 Supervision and Duty of Care The customer is responsible for providing appropriate adult supervision of all children and guests throughout the event and while KidsDreamFactory rental items are in use. Kids Dream Factory does not provide childcare, babysitting, or general supervision services. The customer is responsible for ensuring that all guests use the rental items safely and in accordance with any instructions provided by Kids Dream Factory.
6. Damage, Loss, and Theft
6.1 Responsibility for Damage, Loss, or Theft The customer is responsible for any damage to, loss of, or theft of Kids Dream Factory rental items occurring during the rental period, except for normal wear and tear. If an item is damaged but can be repaired, the customer may be charged the reasonable cost of repair. If an item is lost, stolen, or damaged beyond repair, the customer may be charged the reasonable replacement cost of the item.
6.2 Inappropriate or Unsafe Conduct KidsDreamFactory reserves the right to stop setup, terminate Services, and leave the premises immediately if the customer or any guest engages in threatening, abusive, harassing, unsafe, or illegal conduct toward our team, or if conditions at the event make it unsafe or unreasonable for us to continue providing the Services. In such circumstances, payments already made are non-refundable. Kids Dream Factory may contact law enforcement when reasonably necessary.
7. Limitation of Liability
7.1 Rental Items and Services KidsDreamFactory will provide rental items and Services in reasonable working condition and as described in the confirmed booking. Colors, decorations, accessories, and individual items may vary from photographs shown on the website due to availability. Any substitutions will be made with the intention of maintaining the overall theme and quality of the selected setup.
7.2 Limitation of Liability To the fullest extent permitted by applicable law, KidsDreamFactory is not responsible for loss, damage, injury, or additional costs resulting from the misuse of rental items, failure to follow provided instructions, unsafe conditions created by the customer or guests, or circumstances outside KidsDreamFactory’s reasonable control. KidsDreamFactory will not be liable for indirect, incidental, special, or consequential damages arising from the Services. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
7.3 Responsibility for Guests and Third Parties The customer is responsible for the conduct of their guests and for ensuring that all guests comply with these Terms and any safety instructions provided by KidsDreamFactory. To the fullest extent permitted by applicable law, the customer agrees to indemnify and hold KidsDreamFactory harmless from third-party claims, damages, losses, or reasonable legal costs to the extent caused by the acts, omissions, misuse of rental items, or violation of these Terms by the customer or their guests. This provision does not apply to the extent that a claim results from KidsDreamFactory’s own negligence, gross negligence, or willful misconduct.
8. Environmental and Safety Requirements
8.1 Non-Smoking, Food, Pets & Rental Items The customer must provide a smoke-free environment at all times while KidsDreamFactory rental items are on the premises. Smoking and vaping are not permitted in or around the rental setup. Pets must be kept away from all tents, mattresses, bedding, decorations, and other rental items. Food and drinks are not permitted inside the tents, and shoes must be removed before entering or using the tents. The customer is responsible for ensuring that all guests follow these requirements throughout the rental period.
8.2 Prohibited Items and Materials Paint, nail polish, slime, glitter, and other materials that may permanently stain, damage, or contaminate rental items are strictly prohibited in or around the tents and rental setup. Wet items must not be placed on mattresses, bedding, rugs, cushions, tents, or other rental items. If prohibited items or materials result in stains or excessive cleaning, a $75 damage fee plus a $100 cleaning fee per affected tent may apply. Any damage requiring repair or replacement will also be handled in accordance with Section 6.1.
9. Photography and Media Usage
9.1 Photography and Media Usage KidsDreamFactory may photograph or record party setups, decorations, and rental items for portfolio, website, social media, and marketing purposes. KidsDreamFactory will not use photographs or videos in which a customer, child, or guest is identifiable for marketing or promotional purposes without appropriate consent. For minors, consent must be provided by a parent or legal guardian. Permission to use photographs or videos of identifiable individuals may be requested separately and is not a condition of booking KidsDreamFactory’s Services.
9.1 Photo/Media Consent Any consent to use photographs or videos showing identifiable customers, children, or guests for marketing, advertising, social media, website content, or other promotional purposes must be provided separately. For any identifiable minor, consent must be provided by a parent or legal guardian. Providing such consent is voluntary and is not required in order to book or receive Services from KidsDreamFactory. 10. Use of Content
All content made available on this Site, including photographs, images, text, graphics, designs, and logos, is owned by or licensed to KidsDreamFactory unless otherwise stated. Such content may be protected by applicable copyright, trademark, and other intellectual property laws. You may view the content for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, publish, sell, or otherwise use Site content for commercial purposes without prior written permission from KidsDreamFactory or the applicable rights holder.
11. Changes to Terms
KidsDreamFactory may update or modify these Terms from time to time. Any revised Terms will be posted on this Site and will become effective on the date stated in the updated Terms. Unless required by applicable law or otherwise agreed in writing, changes to these Terms will not apply retroactively to bookings that were already confirmed before the revised Terms became effective. Confirmed bookings will remain subject to the Terms in effect at the time the booking was confirmed.
12. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Services provided by KidsDreamFactory will be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action or proceeding arising from these Terms or the Services must be brought in a court of competent jurisdiction in the State of Florida, subject to applicable law.
